25. Reapplying after Refusal of an NLPNP Application

An application may be deemed ineligible for nomination if:

  • the program criteria are not met;
  • the applicant does not submit the required documentation as requested by the NLPNP to provide proof of eligibility;
  • the applicant fails to establish a genuine intention to reside in Newfoundland and Labrador;
  • the applicant fails to convince the Immigration Program Development Officer that they are able to become economically established;
  • the applicant has intentionally misrepresented themselves in the application; and
  • the information provided by the applicant is incomplete and incorrect.

If the application is refused under ordinary, non-contentious circumstances (e.g., not working in field of study, or not meeting the language requirements), then the applicant may reapply following the receipt of final closure letter, should they be eligible.

If the application is refused due to concerns over the applicant’s intention to reside, then the applicant will be eligible to reapply after waiting a period of one year from the date of refusal.

PROCEDURES:

  1. The Office of Immigration may accept an application from an applicant who was previously refused. The Immigration Program Development Officer will review the reason(s) the application was initially refused and ensure the applicant has waited the applicable timeframe, if applicable.
  2. If the Immigration Program Development Officer previously refused the file, the Officer will inform the Manager or Director that they previously made a decision on this file. The Manager or Director will advise the Officer to either continue assessing the file, or they will transfer the file to a new Immigration Program Development Officer. This decision will be made on a case by case basis.
  3. The Immigration Program Development Officer will always apply the current policies of the NLPNP to an application. If a policy has changed between the applicant’s prior application and their current application, the new policy will be applied.
