De-designation

Overview

As per the Canada-Newfoundland and Labrador Agreement on the Atlantic Immigration Program, the Department of Jobs, Growth and Rural Development (JGRD), through the Office of Immigration and Multiculturalism (OIM), are responsible for designating local employers under the Atlantic Immigration Program (AIP). Becoming an AIP-designated employer allows employers to select qualified international workers to work in their businesses.

OIM is directly responsible for endorsing candidates under the AIP, provided the applicant meets all application criteria. OIM is also responsible for monitoring and ensuring an employer’s compliance to the program. If an employer is found to be or have been non-compliant, they may have their AIP designation revoked and cancelled, known as de-designation.

An employer may be de-designated for any of the following reasons:

  • Newfoundland and Labrador has program integrity concerns involving the employer or becomes aware of fraud or misrepresentation committed by the employer at any point before, during, or after the designation process.
  • Newfoundland and Labrador becomes aware that the employer no longer fully meets the requirements and criteria outlined in the endorsement and designation application forms.
  • The employer has violated the Immigration and Refugee Protection Act (IRPA) and/or the Immigration and Refugee Protection Regulations (IRPR).
  • The employer is found to not have a respectful and inclusive workplace.
  • The employer has been found non-complaint with provincial or federal legislation, such as the Labour Standards Act or the Canadian Human Rights Act.
