Important Information for Refugee Claimants Living in Canada

If you’ve made a refugee claim in Canada, here’s what you need to know about applying for permanent residence through certain immigration programs.
Can I apply for the Atlantic Immigration Program or the Newfoundland and Labrador Provincial Nominee Program?
Right now, refugee claimants living in Canada can’t apply for these programs. That’s because both programs require you to have temporary resident status—and refugee claimants don’t have that status, even if you have a work or study permit.
Can I still work or study while I wait for a decision?
Yes! You can apply for an S61 open work permit or a study permit. These allow you to work or go to school while your refugee claim is being processed.
What happens after my refugee claim is decided?
- If your claim is approved, you can apply for permanent residence as a protected person.
- If your claim is refused, a removal order will take effect, and you’ll be expected to leave Canada. You might be able to appeal a negative decision if you meet the requirements. Learn more here.
Can I apply for those programs from outside Canada?
Yes, you can! If you leave Canada and meet the requirements, you may be able to apply for the Atlantic Immigration Program or the Newfoundland and Labrador Provincial Nominee Program from outside the country.
