The Honourable Bernard Davis, Minister of Environment and Climate Change, has announced the following events relative to Part 10 Environmental Assessment of the Environmental Protection Act.
UNDERTAKINGS REGISTERED:
Paradise Microbrewery (Reg. 2168)
Proponent: Banished Brewing Ltd.
The proponent is proposing to establish and operate a 30-barrel capacity microbrewery within an existing building located at 9 Maverick Place, Paradise. Renovations will include floor sloping, addition of plumbing drainage and electrical and mechanical upgrades. The facility will use the municipal water and sewer systems and operate year-round.
The undertaking was registered on September 15, 2021; the deadline for public comment is October 21, 2021; and, the minister’s decision is due by October 30, 2021.
North Brook (Deer Lake East) Bridge Installation (Reg. 2169)
Proponent: Department of Fisheries, Forestry and Agriculture
The proponent is proposing to construct a 30-metre bridge on North Brook located near the north shore of Deer Lake, approximately seven kilometres west of Route 430 (Viking Trail) in the Humber Valley area. The bridge installation is proposed to access Agriculture Area of Interest 46.
The undertaking was registered on September 16, 2021; the deadline for public comment is October 21, 2021; and, the minister’s decision is due by October 31, 2021.
UNDERTAKINGS RELEASED:
Nain Wind Power Micro-Grid (Reg. 2118)
Proponent: Nunatsiavut Government and Natural Forces Development Limited Partnership
The project is released subject to the following conditions:
- The proponent is required to uphold all commitments made in the environmental assessment submission to mitigate the effects of the project on the environment.
- The Water Resources Management Division of the Department of Environment and Climate Change requires that the proponent collect GPS waypoints to ground truth the boundary of the Trouser Lake Protected Public Water Supply Area (PPSWA). This area must be clearly marked during construction and there is to be no development within the PPSWA. The GPS waypoints and boundary information must be provided to the Water Resources Management Division.
- The Department of Fisheries, Forestry and Agriculture advises that the proponent is to conduct surveys and submit an Environmental Effects Monitoring Plan for review by the Wildlife Division of that Department prior to construction. Specifically, the proponent is required to:
Bats
-
- Submit previously conducted bat surveys for a determination of whether further pre-construction monitoring is required;
- Discuss monitoring programs with the Wildlife Division prior to construction and potentially during operations;
- Propose adequate mitigations for resident as well as migratory bats, if present; and,
- Conduct regular mortality surveys for bats during operational phases of the project.
Short-eared Owls
-
- Discuss with the Wildlife Division a targeted breeding bird survey for the Short-eared Owl prior to the construction of crane pads and turbine foundations; and,
- Conduct regular mortality surveys for avian species during operational phases.
Peregrine Falcon
-
- Discuss with the Wildlife Division pre-construction Peregrine Falcon nest search surveys within 20 kilometres of the proposed turbine(s). These data are collected annually by Wildlife Division and can be shared with the proponent; and,
- Conduct regular mortality surveys for the Peregrine Falcon during operational phases of the project.
- The Pollution Prevention Division of of the Department of Environment and Climate Change and the Department of Digital Government and Service NL require the proponent to submit a Waste Management Plan and an Environmental and Safety Contingency plan for both the construction and operation phases of the project. These plans may be combined as an Environmental Management and Protection Plan, which the proponent has committed to developing in the environmental assessment registration document, and must be approved by both departments prior to construction.
- The Office for Women and Gender Equality requires that the proponent develop a Women’s Employment Plan (WEP) to be approved by the Deputy Minister for that Office. The WEP should identify specific commitments to support the recruitment, training, employment and retention of women.
- The proponent is required to advise the Environmental Assessment Division when the conditions of release have been met, by emailing a written description, documents, and images (where applicable) to demonstrate that the conditions have been fulfilled.
- The proponent is required to update the Environmental Assessment Division on the status of the project, including a copy of all permits, licences, certificates, approvals and other authorizations required for the project, one year from the date of this release letter and to provide additional updates if requested.
Parker’s River Arctic Char – Atlantic Salmon Habitat Restoration (Reg. 2147)
Proponent: World Wildlife Fund Canada
The project was released subject to the following conditions:
- The proponent is required to uphold all commitments made in the environmental assessment submission to mitigate the effects of the project on the environment.
- The proponent is required to update the Environmental Assessment Division on the status of the project, including a copy of all permits, licenses, certificates, approvals and other authorizations required for the project, one year from the date of this release letter and to provide additional updates if requested
Miles Cove Marina (Reg. 2157)
Proponent: Town of Miles Cove
The project was released subject to the following conditions:
- The proponent is required to uphold all commitments made in the environmental assessment submission to mitigate the effects of the project on the environment.
- The proponent is required to update the Environmental Assessment Division on the status of the project, including a copy of all permits, licenses, certificates, approvals and other authorizations required for the project, one year from the date of this release letter and to provide additional updates if requested.
Aspen Brook Bridge Replacement (Reg. 2160)
Proponent: Department of Transportation and Infrastructure
The project was released subject to the following conditions:
