The Honourable Bernard Davis, Minister of Environment and Climate Change, has announced the following events relative to Part 10 Environmental Assessment of the Environmental Protection Act.

UNDERTAKING REGISTERED:

Portugal Cove-St. Philips Marine Ingredients Plant                         (Reg. 2174)
Proponent: Windy Heights Farm and
63562 Newfoundland and Labrador Limited

The proponent is proposing the development of a bio-processing plant that converts non-food grade fish protein into agricultural fertilizer, at an existing 161.8-hectare farm located at 374 Bauline Line Extension, Portugal Cove-St. Philips. Construction activities include upgrading the interior and exterior of an existing barn, constructing a utilities shed, landscaping to support truck turnarounds and loading/offloading zones, and installing office and lab space.

The undertaking was registered on October 14, 2021; the deadline for public comment is November 18, 2021; and, the minister’s decision is due by November 28, 2021.

ENVIRONMENTAL PREVIEW REPORT REQUIRED AND ENVIRONMENTAL ASSESSMENT COMMITTEE APPOINTED:

Foxtrap Incinerator Road Naturally Occurring Radioactive          (Reg. 2166)
Material (NORM) Storage and Decontamination Facility
Proponent: Pardy’s Waste Management and Industrial Services Limited

The minister has advised the proponent that an environmental preview report (EPR) is required for this project. Additional information is needed to inform the minister of the potential environmental effects, including, but not limited to;

  • a hydrogeological assessment that considers the potential effects of the project on other groundwater use in the area, and measures that will be undertaken to mitigate adverse effects;
  • a description of the potential effects of the project on the surrounding area, particularly on adjacent commercial and industrial properties, ambient water quality, recreational use, and measures that will be undertaken to mitigate adverse effects;
  • a description of the transportation route and equipment proposed to transport NORM material to and from the facility, including potential effects on human receptors along the transportation route;
  • details on the decontamination process;
  • details on the NORM storage area;
  • details on the monitoring, engineering and administrative controls that will be employed  to ensure the as low as reasonably achievable (ALARA) principle will be met for exposure levels; and,
  • a decommissioning plan for the proposed facility.

An Environmental Assessment Committee has been appointed to provide scientific and technical advice to the minister and to draft guidelines for the proponent in preparing the EPR. The Environmental Assessment Committee includes representatives from the following provincial government agencies:

  • Department of Environment and Climate Change
    • Environmental Assessment Division – Chair
    • Pollution Prevention Division
    • Water Resources Management Division
  • Department of Digital Government and Service NL
    • Government Service Centre
  • Environment and Climate Change Canada

The project is released subject to the following conditions:

  • The proponent is required to uphold all commitments made in the environmental assessment submission to mitigate the effects of the project on the environment.
  • The proponent is required to update the Environmental Assessment Division on the status of the project, including a copy of all permits, licences, certificates, approvals and other authorizations required for the project, one year from the date of this release letter and to provide additional updates if requested.
