| Report: | A-2021-047 |
| Report Date: | November 25, 2021 |
| Public Body: | Memorial University |
| Summary: | The Complainant submitted an access request to Memorial University under the Access to Information and Protection of Privacy Act, 2015 for records relating to an application for approval to disregard a request which had been made by Memorial to this Office. Memorial provided a number of responsive records to the Complainant, with some redactions claiming sections 30(1)(a) (legal advice), 40(1) (disclosure harmful to personal privacy), and 41(c) (disclosure of House of Assembly service and statutory office records). The Complainant objected to some of these redactions, alleged that Memorial breached its requirement of anonymity under section 12, and that Memorial did not meet its duty to assist under section 13. The Commissioner recommended that Memorial continue to withhold the redacted information, concluded that there was no evidence that Memorial breached the anonymity requirement, and that Memorial had fulfilled its duty to assist the Complainant. |
