| Summary: | The Department of Industry, Energy and Technology received a request for documents related to the acquisition of the Come by Chance refinery. The Third Party was notified of the Department’s intention to release the records and subsequently objected to the release of certain information contained within a memorandum of understanding. The Third Party filed a complaint with this Office, claiming that the information must be withheld under section 39 (disclosure harmful to business interests of a third party). The Commissioner found that the burden of proof had not been met and recommended that the information be released. |
