| Summary: | The Complainant made a request under the Access to Information and Protection of Privacy Act, 2015 to the Department of Justice and Public Safety for records relating to the Public Inquiry Respecting Ground Search and Rescue for Lost and Missing Persons. The Department disclosed records but withheld some information pursuant to section 27 (cabinet confidences), section 29 (policy advice or recommendations), section 30 (legal advice), section 31 (disclosure harmful to law enforcement), and section 40 (disclosure harmful to personal privacy). The Complainant asked this Office to review the redactions. The Commissioner concluded that the Department had correctly applied sections 27, 29, 31, and 40; however, the Commissioner also determined that the Department of Justice and Public Safety did not provide evidence to conclude that section 30 applied to the withheld information. The Commissioner recommended that the Department disclose the information it had withheld pursuant to section 30 but to continue to withhold information subject to the other sections. |
