| Summary: | The City of Mount Pearl received a request under the Access to Information and Protection of Privacy Act, 2015 for a workplace investigation report. The City withheld the report in its entirety. The Commissioner reviewed the report and concluded, following recent court decisions, that although section 33 (information from a workplace investigation) mandated disclosure of the report, any disclosure is nevertheless subject to the restrictions on disclosure in section 40 (disclosure harmful to personal privacy). In this case the Commissioner was satisfied that a line-by-line review showed that disclosure of virtually all of the information in the report would be an unreasonable invasion of privacy, and recommended that the City continue to withhold the entire report. |
