The Office of the Information and Privacy Commissioner has released Report A-2024-054 under authority of the Access to Information and Protection of Privacy Act, 2015. A summary of the Report is included below.

| Summary: | The Complainant made an access to information request to Newfoundland and Labrador Hydro for a report it had commissioned about employee compensation. NL Hydro withheld the report in its entirety pursuant to sections 29(1)(a) (policy advice or recommendations); 35(1)(d), (f), and (g) (disclosure harmful to the financial or economic interests of a public body); and 38(1)(a) and (b)(i) (disclosure harmful to labour relations interests of public body as employer) of the Access to Information and Protection of Privacy Act, 2015. These are all information-level exceptions to access, but had been applied to withhold the entire report. After reviewing NL Hydro’s application of these exceptions to access, it was determined the public body failed to meet its burden of establishing that the exceptions apply to any particular parts of the report. The Commissioner recommended NL Hydro release the report in full. |
