| Summary: | The Complainant made an access request to the Serious Incident Response Team for a copy of an investigative report. The Public Body refused to disclose the record, citing section 5(1)(n) (Application of Act), which provides that the Act does not apply to certain records. The Commissioner concluded that the Serious Incident Response Team had failed to meet the burden of proving that section 5(1)(n) applied to the record, and recommended that it be disclosed, subject to any applicable exceptions to access set out in Division 2 of the Act. |
