Public Body: Newfoundland and Labrador Hydro
Summary: The Complainant made two access requests to Newfoundland and Labrador Hydro for lists of records relating to the work of two law firms on the Churchill Falls agreement between the Governments of Newfoundland and Labrador and Quebec, as well as the contract or agreement with one of the firms and records of payments for its services. NL Hydro responded that lists of such records did not exist, and that any other responsive records were withheld on the basis of section 30 of the Access to Information and Protection of Privacy Act, 2015 (solicitor-client privilege) as well as other exceptions to access. The Commissioner found that NL Hydro had met its duty to assist the applicant under section 13 of the Act by conducting a reasonable search for records, that it was entitled to withhold the records under section 30 of the Act, and that it was not necessary to consider the application of other exceptions to access.
